These Terms and Conditions (Terms) govern access to and use of the TripRDC platform (the Service), operated to help people discover, book, and connect around tourism in the Democratic Republic of the Congo.
By accessing the Service or creating an account, you agree to these Terms. If you do not agree, please do not use the Service.
1. Purpose and scope
TripRDC provides a digital platform that may allow users to:
- browse destinations, attractions, accommodation, restaurants, experiences, and mobility services;
- make bookings or requests based on available offers;
- enable professional partners to publish and manage listings, subject to a separate partner agreement.
These Terms apply to all users (visitors, customers, partners). Commercial terms specific to partners (commission, pricing mode, listing obligations) are set out in the applicable partner contract and/or published commercial terms.
2. Definitions
- User: any person accessing the Service.
- Customer: a user who books or purchases a service through the Service.
- Partner: a professional (hotel, apartment, restaurant, fleet, attraction, etc.) offering services through the Service.
- Listing: a descriptive offer page published by a Partner.
- Platform: TripRDC websites, applications, and APIs.
3. Access and accounts
Some features require an account. You agree to:
- provide accurate information and keep it up to date;
- keep your credentials confidential;
- notify us promptly of any unauthorized use of your account.
TripRDC may suspend or close an account in case of Terms violations, suspected fraud, or for security or compliance reasons.
3.1 Sign in with Google
You may create an account or sign in with Google. By choosing this option, you authorize TripRDC to receive the profile information Google provides in this context (including email address, display name, and profile picture), as described in our Privacy policy. You also accept these Terms.
4. Role of TripRDC
Unless otherwise stated in writing:
- TripRDC primarily acts as a technical intermediary between Customers and Partners;
- tourism services (accommodation, dining, experiences, vehicles, etc.) are provided by Partners;
- the service contract is formed, as applicable, between the Customer and the Partner, or as indicated at the time of booking.
TripRDC does not guarantee uninterrupted availability of the Service, nor absolute accuracy of all Partner-published information, despite reasonable moderation and quality efforts.
5. Listings and content
5.1 Partner content
Partners are responsible for the accuracy, lawfulness, and currency of their Listings (prices, availability, photos, descriptions, cancellation rules, etc.).
5.2 User content
Reviews, comments, and other User-published content must be fair, non-defamatory, and lawful. TripRDC may moderate, hide, or remove inappropriate content.
You grant TripRDC a non-exclusive, worldwide, royalty-free license to host, display, and distribute content you publish on the Service, solely as needed to operate and promote the Service.
6. Bookings, pricing, and payments
- Displayed prices may be in USD or another indicated currency.
- Fees, taxes, commissions, and pricing modes (including inclusive or exclusive commission for Partners) are shown at booking time or in the partner contract.
- Payments are processed through payment providers integrated into the Service. TripRDC does not store full card details when processing is delegated to a certified provider.
- A booking confirmation (email or account area) evidences the accepted details, subject to payment validation and Partner rules.
7. Cancellations, refunds, and disputes
Cancellation and refund rules depend on the offer, the Partner, and the terms shown at booking time.
In case of a dispute between Customer and Partner, TripRDC may, at its discretion, facilitate technical mediation (messaging, booking status, refunds under applicable rules), without any obligation of result and without replacing the parties' legal remedies.
8. User obligations
You agree not to:
- use the Service for unlawful, fraudulent, or public-order-violating purposes;
- disrupt technical operations (abusive scraping, attacks, security circumvention);
- impersonate others or publish false information;
- infringe intellectual property rights of TripRDC or third parties.
9. Intellectual property
The TripRDC brand, logos, interface, editorial texts, and Platform graphics are protected. Unauthorized reproduction is prohibited.
Partner-provided content remains their property, subject to licenses needed for distribution on the Service.
10. Personal data
Personal data processing is described in the Privacy policy. By using the Service, you acknowledge that you have read it.
11. Liability
To the extent permitted by applicable law:
- TripRDC is not liable for indirect damages (loss of opportunity, lost profits, etc.);
- where TripRDC's liability is engaged, it is limited to the service fees actually received by TripRDC for the relevant transaction over the previous twelve (12) months, or a reasonable equivalent amount if no fee was received;
- TripRDC is not liable for Partners' failures in performing their services, except where TripRDC's proven fault in its intermediary role is established.
12. Suspension and termination
TripRDC may modify, suspend, or discontinue all or part of the Service for maintenance, security, product changes, or force majeure.
You may stop using the Service at any time. Account closure may be requested through available user-area procedures or support channels.
13. Changes to these Terms
TripRDC may update these Terms. The update date appears at the top of this page. For material changes, notice may be provided via the Service or email. Continued use after the effective date constitutes acceptance of the updated Terms, unless mandatory law provides otherwise.
14. Governing law and disputes
Subject to mandatory contrary provisions, these Terms are governed by the laws applicable in the Democratic Republic of the Congo, without prejudice to consumer rights you may have in your country of residence.
In case of dispute, the parties shall first seek an amicable resolution before any legal action.
15. Contact
